Carrier is willing to act as a subscribed trucking company, and XSCapacity agrees to act as Freight information provider. Both Xscapacity and Carrier represent and warrant to the other that they have obtained all necessary and appropriate licensing and authority to perform their respective services under this agreement. Note: XSCapacity is not a Transportation broker but a provider of information using technology and does not warranty class or other any other related information. As such, we do not fall under brokerage licensing regulations. There will be no fees associated with having access to the ltcquickbid.com web application with the exception of the successful bidding fee. Trucking companies agree to terms set forth by the shipping company with regards to invoice submission with respect to accepted bids to the extent that such terms are disclosed to Carrier and agreed to by Carrier. Trucking companies agree to pay a Fee/commission based on awarded bids in the amount of 10.00% of the total bid with net terms of 30 days, Should any payment be later than this, carrier agrees to provide credit card for billing. Trucking companies agree to keep transportation request updated as to progress in a timely manner or to utilize their own tools to keep the status updated and upon completion of the transaction mark the status as delivered. Their communications should be directed to the shipper and not IBP Corporation. All shipments will be subject to the terms and conditions, including but not limited to levels of valuation, contained in the Bill of Lading applicable to such shipments as provided to the shipper from the carrier. Trucking companies agree to provide the highest level of quality service for the shippers and their customers. Should their quality survey score remain below 2.1 for greater than two months, they will be considered for removal from the system. XSCapacity agrees to keep all bids confidential, and act with fiduciary responsibility to both the Shipper and the Trucking Company.
